Prospective Clients (Estate Planning)

This page is designed to help new clients undertand how to work with us and next steps to take. The following Frequently Asked Questions will help direct you in the right direction.

  • What is estate planning all about?

    Estate Planning is all about organizing your financial and legal affairs so that in case of your incapacity or death, your loved ones will be able to:

    During your incapacity...

    -  seamlessly access your financial assets to assist you (pay your bills, etc.);

    -  make medical and other personal care decisions for you;

    After your death...

    -  ensure the appropriate guardian(s) are appointed to care for your minor children;

    -  hold and protect your assets for a period of time for those minor or immature adult beneficiaries; and

    -  distribute your assets to your mature adult beneficiaries;

    Regardless of inapacity or death, a primary goal of a comprehensive estate plan is to avoid the headache, expense, and delay of court involvement.

  • Why should I hire an attorney?

    You can try to do this yourself. However, our experience is that the vast majority of people who attempt to complete their estate planning on their own make several critical mistakes such that the ultimate expense (whether due to the need for conservatorship, probate, or litigation among family members) due to poorly drafted documents far exceeds the cost and peace of mind had the planning been done initially with a qualified attorney.

    A few of the typical mistakes people make doing this on their own:

    -  They fail to fully fund their trust;

    -  They fail to coordinate beneficiary designations for non-trust assets such as retirement accounts;

    - They fail to understand the most tax efficient ways to distribute their assets to their beneficiaries; and

    -  They create documents that are inconsistent with each other and therefore result in confusion and/or litigation among family members.

  • Which attorney should I work with?

    You can learn about each of the attorney on "Our Team" page.

    Grant Pederson is currently focusing on providing excellent service to his existing clients. Therefore he is only seeing new clients who have been directly referred to from professional advisors due to either complex assets/family dynamics or estate values greater than $15 million (single) or $30 million (married). In those cases, you will benefit from Grant's expertise.

    If you have a less complex estate, meaning, non-blended family, traditional assets such as one house, investments, life insurance and retirement plans, and your estate is below $10 million (single) and $20 million (married) you should work with one of our firm's associates, Todd Vigneux, Russell Jokela, or Camille Aceituno. They are incredibly competent, less expensive than Grant, and more readily available to assist.

    Regardless of which attorney you work with, know that as a boutique firm we all work together to ensure we're providing our clients the best service and solutions possible.
